Terms of service and rules
for the conclusion of a contract for the provision of paid services

This document is an official offer (public offer) and contains all the essential terms for the provision of services via the online freelance service (hereinafter — the "Service").
Acceptance of this Offer means full and unconditional acceptance of the terms of this contract.
Service — a software and hardware system available at:
https://zelenka.work, intended for interaction between Customers and Executors.

User — an individual or legal entity that has registered with the Service.
Customer — a User who posts tasks and pays for services.
Executor — a User who completes Customers' tasks.
Acceptance — full and unconditional acceptance of the terms of this Offer by registering with the Service and/or starting to use its functionality.
2.1. The Operator provides Users with access to the Service's functionality for posting, searching for and completing tasks, as well as for making settlements between Customers and Executors.
2.2. The Operator is not a party to arrangements between the Customer and the Executor, unless expressly stated otherwise.
2.3. The Operator's services may include:
3.1. To use the Service, the User must register and provide accurate data.
3.2. The User is responsible for the security of their credentials and for actions performed through their account.
3.3. The Operator may suspend or delete an account if the terms of the Offer are violated.
4.1. The Customer posts a task describing the terms, deadlines and price.
4.2. The Executor responds to the task or is engaged by the Customer directly.
4.3. The terms of performance of the work are recorded in the Service's interface (correspondence, order card, etc.).
4.4. After completion of the task, the Customer confirms the result or sends reasoned objections.
5.1. Use of the Service may be subject to a fee. The amount of the commissions is indicated on the website or in the Service's interface.
5.2. The Operator may withhold a commission from payments between the Customer and the Executor.
5.3. All settlements are made using the methods available in the Service.
5.4. The User independently bears the tax obligations arising in connection with the receipt of income.
7.1. The Operator is not liable for:

8.1. Personal data is processed in accordance with the Privacy Policy.
8.2. Acceptance of the Offer means the User's consent to the processing of personal data.
9.1. All rights to the software and content of the Service belong to the Operator or its partners.
9.2. The User receives a limited right to use the Service without any transfer of exclusive rights.
10.1. The contract comes into force from the moment of Acceptance and is valid indefinitely.
10.2. The User may stop using the Service at any time.
10.3. The Operator may terminate the contract unilaterally in the event of a violation of its terms.
11.1. The Operator may make changes to the Offer without prior notice.
11.2. The new revision comes into force from the moment of publication on the website.
12.1. The relations between the parties are governed by the law of Hong Kong SAR.
12.2. Disputes are subject to consideration in the courts of Hong Kong SAR, unless otherwise provided by applicable law.
